The properties in the Village of Westchester commonly known as 10001 Roosevelt Road, 9999 Roosevelt Road, 9999 Derby Lane, 9930 (a/k/a 9914) Derby Lane, and 9909-9919 Roosevelt Road have been noncompliant with the Westchester Municipal Code for some time.
The Village has attempted to collaborate with the property owner and its agents to assist with bringing the properties into compliance with the Westchester Municipal Code. Despite these Village efforts, the property owner and its agents have been unable or unwilling to provide the necessary repairs and maintenance to remediate the numerous code violations and other issues.
As such, and in order to protect the health, safety and welfare of its residents, the Village filed a circuit court action to compel the property owner to remediate the code violations and seek the required inspections and approvals from the Village.
As of January 2, 2025, the Court has granted temporary restraining orders prohibiting the use and occupancy of the properties located at 9999 Roosevelt Road, 9999 Derby Lane and 9930 (a/k/a 9914) Derby Lane. Additionally, the Court has authorized the Village to secure the property located at 9930 (a/k/a 9914) Derby Lane. The circuit court matter is ongoing, and the Village will continue to pursue the matter until the properties are fully compliant with the Westchester Municipal Code.
